Agreement to terms

These Terms and Conditions ("Terms") govern your use of services provided by X ZONE IT SRL ("NODED.CLOUD", "we"). By signing up, ordering a service, or using the NODED.CLOUD control panel, API, or websites, you agree to these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Services we provide

NODED.CLOUD provides cloud hosting infrastructure, including but not limited to: virtual private servers (VPS), streaming VPS, dedicated servers, game server hosting, network connectivity, DDoS protection, NVMe storage, and related support services.

Services are described in detail at NODED.CLOUD. Specifications, pricing, and inclusions are as published on the date you place your order.

Your account

You are responsible for maintaining the confidentiality of your account credentials, for all activity that occurs under your account, and for keeping contact and billing information current.

In short: keep your password safe and your details up to date. We require valid identification on accounts above €1,000/month spend; we may also request KYC at any time for fraud prevention.

Billing and payment

Pricing and currency

Prices are quoted in EUR. VAT is added at the rate applicable to your jurisdiction. Hourly billing is computed per second; monthly billing is invoiced in advance for the upcoming period.

Payment methods

We accept credit and debit cards, PayPal, cryptocurrency (Bitcoin, Ethereum, USDT, USDC), and bank transfers (SEPA / wire). Servers are deployed immediately upon payment confirmation.

Renewals

Monthly services renew automatically. We do not raise the price on renewal; the rate you signed up at is the rate you pay until you choose to upgrade.

Late payment

Invoices are due within 7 days of issue. Services are suspended after 14 days overdue and terminated after 30 days. We send three reminders before any termination.

Cancellation and refunds

Hourly VPS: Cancel any time from the panel; billing stops the second the resource is destroyed.

Monthly VPS and game servers: Cancel any time. We refund unused time, prorated to the day, on a 7-day money-back guarantee for new customers.

Dedicated servers: Minimum term is one month. After the first month, cancel any time with 7 days’ notice. Custom-built configurations may carry a non-refundable hardware-fee component, disclosed at order time.

Refunds are processed back to the original payment method within 14 business days.

Service level agreement

We commit to 99.9% monthly network and power uptime on every service. If we fall below this, service credits are applied automatically to your next invoice — you do not have to ask.

Uptime is measured outside scheduled maintenance and force-majeure events. Maintenance windows are published at least 7 days in advance. The full SLA is available at NODED.CLOUD/sla.

Acceptable use

You may not use our services to:

• Send unsolicited bulk email (spam) or run open mail relays.
• Host or distribute malware, phishing pages, or illegal content.
• Run network-abuse activity such as port scanning, brute-force attacks, or DDoS attacks against third parties.
• Violate copyright, trademark, or other intellectual property rights.
• Host content that violates Romanian or EU law.

What this means in practice: we reserve the right to suspend services immediately upon discovering active abuse, and to share user information with lawful authorities where required.

Your data

You retain ownership of all data you store on our infrastructure. We do not access your data except as required to deliver services or to comply with valid legal process.

You are responsible for backing up your data. We provide hourly snapshots and optional offsite backup as a service, but you remain responsible for verifying that backups meet your recovery requirements.

Limitation of liability

To the maximum extent permitted by law, NODED.CLOUD’s aggregate liability under these Terms is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or lost data.

This limitation does not apply to liability that cannot be limited under applicable law (e.g., gross negligence under Romanian law).

Termination

Either party may terminate the agreement at any time. We may terminate immediately if you breach these Terms in a material way, fail to pay, or use our services for unlawful purposes.

On termination we provide a 30-day grace period during which you can retrieve your data, including paid egress at no extra charge. After 30 days, data is deleted from our systems within 90 days following our deletion procedure.

Governing law

These Terms are governed by the laws of Romania. Disputes that cannot be resolved through good-faith negotiation are submitted to the competent courts of Giurgiu, Romania.

EU consumers retain the protections afforded by mandatory consumer law in their country of residence.

Changes

We may update these Terms. Material changes are notified by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
